In Chertoff's news op he was asked about this. He said certain legal issues applied. However, now that they have changed some things ("breaking the mold" on how they respond and who has authority) it sounded like they will have more freedom to do things.
It sounds ridiculous to hear of "legal issues" now. Perhaps a better term would be "constitutional" issues. I imagine that things are worded as such so the feds can't interfere with the state whenever they want to.

Good point.
It should be as simple as, I the Governor of the State of _____, request all services available through the Federal Gov.
In Blanco's case, I the Governor of Louisiana surrender all my duties to the Federal Government because I know not what I do.
Bottom line_ its sad when a lot of this could have been avoided.
