Unless the State can prove that AL conspired with the driver.

Civilly yes it does.

Especially with Al in the car.

Tacit permission is an acceptable in civil court.
Unless Al can prove that he tried to stop the driver.

Hello? Who is the plaintiff? There is no criminal case against Al, and their are not two parties for a civil case. Next?
