Man dies in scuffle with security guards

A Cleveland man died last Sunday after a scuffle with security guards at the Walmart Super Center located at 6626 FM1960 in Atascocita.

According to witnesses, Stacy Driver ran out of the store and was pursued by Walmart loss prevention employees. A short time later, Driver was dead, and the Walmart employees were trying to explain the last moments of his life to police.

Charles Portz said he was getting out of his car when he saw a heavy blonde haired man being chased by five people who appeared to be security or store employees. He said he saw them wrestling the man to the ground. "The blacktop was extremely hot," said Portz "He had no shirt on and they wouldn't let him up off the blacktop."

According to Portz, Driver began to plead with them men. "He's begging, 'Please call an ambulance, let me up, do something, I'm gonna die," said Portz. He said the loss prevention employees called the police more than once, but another bystander called for an ambulance after realizing Driver was in trouble. Portz said he eventually began to plead with the Walmart employees. "I told them, this guy doesn't look like he's breathing," Portz said, "They said, 'He's all right."

The store employees could not have known that the witness who was pleading with them to let Driver get up from the hot pavement was a high profile Houston attorney, from the Portz and Portz law firm.

Just another glaring example, that occurred today, and why Walmart should not subject or write policy that puts their unarmed, untrained LP guys in grave danger. These two were shot dead, and it appears they weren't even trying to apprehend anyone!

It's a very dangerous world out there. This is what I was trying to get across to some on this thread today, before this latest incident.

He did not die because he stole. He did not die because he ran. He died, because he was held face-down on the hot asphalt for 20 minutes by five security guards.

The article is screw up. Was it security guards, or Loss Prevention employees? Big difference. LP attempts to prevent theft of product, security guards provide security for parking lots, employees, etc.

According to witnesses, Stacy Driver ran out of the store and was pursued by Walmart loss prevention employees.

In my case I made no attempt to run, I just was not going to let them close and get physical control of me as they were trying to do.

I have never experienced any store personnel attempting to take hold of me. If I hear the alarm (or if they call out to me, which has only happened once), I stop, turn, and wait for them to catch up.

Seems like the 'alarm' thingie goes off a lot. I don't think those 'demagnetizers' are all that reliable.

Being from Wisconsin I see where your mindset is also.

Well I, being from Kentucky, which is another state big on property rights (as am I personally), think the LPs were dead wrong. If this guy had caught and hauled off to jail, it would've been a good thing. If he'd gotten humiliated for stealing, it would've been a good thing. If he'd even gotten roughed a bit, he would've earned it. But he didn't earn being suffocated to death. Not for stealing such low value inconsequential items. And especially considering how he was held down and suffocated for 20 minutes.

You are the second one to mention the value of the merchandise. Do you have a monetary threshold amount you would place on property to detain someone? What if it was your property he was stealing. If it was my property I sure would not have a problem with it no matter what the value, it is the principle. Where do people get off thinking it is OK to steal if you can outrun and get away with it. He wasn't able to out run them this time and if had not fought with them he would have still had a shirt on, it got ripped off in the struggle and what a struggle it was.Reports of 10 to 15 minutes to subdue him, no wonder the LP guy said he was high on something. This perp caused all this and there is no one to blame but him.
