Yes, here is Northern CA it is the vietnamese and other asian residents who do this. It is very rude to speak a foreign language and then laugh like hell while looking at a customer!
I see no reason why an employer can't have this rule. They own the business let them run it their way. If the people working there don't like it they can always quit.
BTW, I think a federal law should be passed to prevent anyone who doesn't speak fluid english to work at a drive through window. Trying to understand an accent over the intercom is almost impossible and that goes for phone calls also.

i'll walk out of any asian restaurant where they openly speak other languages in front of customers. my favourite place apparently has policy that it is english only at front of house. i actually heard one of the counter girls request that a customer speak english for the comfort of the other customers (she got a big tip that day)

Try speaking an obscure language they will not understand back at THEM!
They get furious, fast.
In fact they get so mad they break into English in order to complain in a way you can understand.
Samoan works great, but Italian or Gaelic will do in a pinch.
No need to be fluent, just a few words will do the trick.
