It said they weren't allowed to give it to the FBI. But this doesn't mean they didn't report it to their Chain of Command. Anyone in the Service could tell you that intelligence is shared upwards better than downwards. And this one would have had a very high visibility to the upper chain of command unless they were asleep at the switch.
The congressman seems to think the Army had their stuff togeather. If so, the latter isn't likely.
