Yes, it is. People who back out of agreements and lose their deposits are not being "ripped off." It's sad when people get ill, but that doesn't change the legal status.
If you hired a caterer for a wedding and paid a deposit, but then ran away to New Mexico, the caterer would not be "ripping you off" if they didn't give you your deposit back.
