I saw Rick Santorum on CSpan talking about his book. He was asked why Republicans can get mad about Bush's nominees when many of Clinton's appointees had been voted down by the Republican held congress. Santorum made a GREAT point. He said that he didn't disagree with "majority rules", ie if the Dems can get a majority to vote down the nominee in an up or down vote as the Republican held Congress did in the '90s, then, that is how it goes. BUT the way the filibuster is being used today AGAINST tradition of the Senate, the MINORITY is preventing Bush's nominees from getting an up or down vote. In this case, the MINORITY is now in charge of the Senate...and the 2004 elections did NOT put the Dems in charge.

Actually, it's not even a law -- it's in the text of the Constitution.
On second thought, if it's in the text of the Constitution then to a 'Rat it is worthless. Only rights NOT listed in the Constitution get Constitutional Protection as far as they are concerned.

It is unprecedented, in that President Bush has never used recess appointments.
However, if they are implying that recess appointments are unprecidented, then they flat-out lie*.
