All the Neo-Coms will spout this line in an effort to program the American Public... "Bush Lied", "Rove did it", etc.
President Bush is within his authority to make this appointment. It is a result of winning the election...
A minority of Senators cannot stop the executive department from functioning, that's the way the Constitution is written...
The questions that needs to be asked of Dean, Kennedy, Kerry, et al, is How did he abuse his power? Are his actions constitutional? and just to rub it in... What are you going to do about it?

The real abuse of power has been committed by Dems in the Senate. The Senate is constitutionally obligated to vote up or down on all Presidential nominees. Their refusal to bring his nomination to the floor for a vote is unconstitutional. Bills can be filibustered, but technically, nominee's legally cannot. The rules need to be changed to ensure the constitutional process is being followed.
