My point is that O'Connor had no business saying what she said. She stuck her nose in the process pf the selection of the new justice, and she has no business being there.
I understand your point I think and I agree. But if O'connor said she would stay for "as long as it took" and it took 6 weeks for Bush to make a recess appointment, then her conditions of departure would be met. Maybe we can deal with a better Congress after the next election.
