NRA-ILA Grassroots Alert Vol. 12, SPECIAL ALERT 7/28/05

TODAY'S UPDATE ON S. 397 (July 28, 2005)-- "The Protection Of Lawful Commerce In Arms Act"

Today the U.S. Senate took a number of actions related to S. 397, as debate winds down with a vote on final passage expected in the next 24 hours. Among the Senate's actions today:

Passage by a vote of 70-30 of an amendment by Senator Herb Kohl (D-Wisc.) that requires federally licensed dealers to provide a "secure gun storage or safety device" (e.g., trigger locks, cable locks, safes, gun cases, a lock box, etc.) with the sale/transfer of every handgun (does not apply to long guns). It does not require gun owners to use the device, and does not create any new civil liability for gun owners who choose not to use these storage devices. Virtually all new handguns today are sold with some type of secure storage or safety device. The Kohl Amendment does not have any significant impact on current law or S. 397 itself.

Tabling (and thus, killing) an amendment by Senator Carl Levin (D-Mich.) by a vote of 62-37. The Levin Amendment would have gutted S. 397, creating a giant loophole for anti-gun activist lawyers, allowing exactly the type of lawsuits this bill is intended to prevent. Last year this same amendment was decisively defeated. Please contact your U.S. Senators IMMEDIATELY and urge them to support S. 397 without any anti-gun amendments. Be sure to tell your Senators that you consider any vote for anti-gun amendments as a vote against S. 397 itself.

ON FRIDAY, JULY 29, THERE WILL BE VOTES ON ANTI-GUN AMENDMENTS TO BAN AMMUNITION AND GUT THE LEGISLATION!

(For more complete information on S. 397, and to contact your U.S. Senators, please go to http://www.nraila.org/stoprecklesslawsuits.aspx. You may also call your U.S. Senators at (202) 224-3121. Please IMMEDIATELY share this information with everyone you know who supports the Second Amendment.

Call today your Senators TODAY. Anti-gun Senators are trying everything to stop this bill. Last year at this point they tacked on amendments designed to kill the bill, and it worked. We can't let that happen again, if this bill is not made into law the American gun industry will continue to be sued out of business with bogus lawsuits designed solely to bankrupt the industry and stop all gun manufacturing and importing into the U.S.

Let your Senators, especially Republican Senators, know that we won't stand for them allowing the Democrats to pull that kind of trickery again this time. Demand NO MORE AMENDMENTS TO THIS BILL!! PASS IT TODAY!!

Senate switchboard # is (202) 224-3121

Thanks for bumping. This will probably be the critical day for this extremely important bill. If there is a repeat of last year's fiasco in which the Pubs allowed the bill to be loaded down with anti-gun amendments there may not be another chance to remedy the current situation, and the US firearms industry could be shut down. We have to let them know we won't stand for another fiasco like last year's now that the Pubs have a solid majority in the Senate.

I will be in and out today, so I can't keep the article bumped as often as I would like. I will appreciate anyone giving it a bump so that it will be seen by as many as possible. Light up that Senate switchboard early and often today if you care about saving the American gun industry from the liberal antigunners.

How stupid is it, and what does this amendment accomplish if the law will have NO SIGNIFICANT IMPACT ON THE CURRENT LAW?

All this will do is artificially jack-up the price of a handgun, and thus, place them out of the reach of most Americans.

I have wrote, emailed, and organized everyone in my area against amendments to this bill. Unfortunately Liberal Sen. Carl Levin, and Sen. Stab-me-now ignore anyone who does not believe in SOCIALISM!

The gunlock amendment is unnecessary and annoying, but it doesn't place a major burden on gun buyers or manufacturers. Most gunmakers already supply either a trigger lock or a built-in lock with every gun. Trigger locks are cheap ($3-$4 at Walmart) so even if some makers aren't currently including them, the cost for adding one to each gun should be minimal.

If that's the price it takes to pass this bill and save the American firearms industry I can live with it.

This following in italics was taken off the Coalition to Stop Gun Violence website. They are going all out to get their people to call the Senate, and I am sure that every other anti-gun org is doing the same. We need 100 calls in favor of the bill for every one of their anti-gun callers. If any of those amendments are tacked on to the bill it's as good as dead.

July 29, 2004

URGENT ACTION ALERT: IMMUNITY VOTE TODAY! CONTACT SENATE AGAIN!

Dear ?????,

We need your help today again as we have our last chance to weaken or stop the NRA-sponsored gun industry immunity bill (S. 397).

Today, 4 amendments will be dealt with that weaken the bill. Support for these amendments are the best chance we have to protect justice for gun victims.

These four amendments would preserve the right of police officers injured by guns to sue, another would preserve the right for children, a third would allow all individuals (but not cities) to sue, and the last one would block the sale of cop-killer bullets.

After these amendments are dealt with, a final vote on S. 397 will take place today.

WE NEED YOUR HELP RIGHT NOW:

STEP 1: CONTACT BOTH OF YOUR SENATORS NOW

Call the Capitol Switchboard at 202-224-3121. Or you can find your Senators' direct numbers in DC here: http://action.csgv.org/legdirectory/

STEP 2: Urge Them to: "Vote NO on S. 397 and Vote YES on:
1. Reed Amendment No. 1642 (suits by individuals)
2. Kennedy amendment No. 1615 (cop-killer bullets)
3. Corzine Amendment No. 1619 (suits by children)
4. Lautenberg Amendment No. 1620 (suits by law enforcement)

STEP 3: SPREAD THE WORD!
Forward this action alert to your email address books. http://action.csgv.org/tellafriend/

Please call your Senators without delay, it only takes 2 minutes and could make a big difference!

Thank you for your help in opposing this dangerous legislation.

This is the kind of big lie technique that the MSM is using against the Senate bill. I can only paste a small part of the article, but I am adding a link to the site for anyone interested in seeing the lies and distorions the antis are using against this bill.

(CBS) The gun lobby is about to squeeze the trigger on its biggest shot in the post-Columbine era and perhaps its greatest bull's eye ever. But it's Senate Democrats who deserve the credit here because they're the ones who have changed course, wimping out and giving in on one of the most inane pieces of legislation a legislature could concoct. The Firearms Manufacturers Protection Act............LINK

The antis realize how vitally important it is for their agenda that this bill be stopped. I only wish our side realized the same thing. The right to keep and bear arms doesn't mean much if you can't buy a firearm, and if all gun makers and importers are sued out of business that's exactly what will happen.

The Senate is voting on this right now. Apparently, Mukulski wanted an amendment, Craig didn't like it so he offered a counter amendment to his bill. No idea what the text of the amendment is as I just tuned in, but the usual suspects are all voting against the amendment to the bill.

Doesn't sound like Lautenberg's amendment, whatever it was, didn't pass. Reading the roll and official votes now.

They must have read all these off earlier and are just doing the votes now. I can't find the text of any of these purposed amendments. Mukulski, Lautenberg, Kennedy, et al... you can pretty much guess what kind of crap they would try and get attached to kill the bill, but it is driving me nuts not knowing.

Shot down Lautenbergs amendment. Motion to reconsider has been accepted. Kennedy amendment up next. The Swimmer to bloviate for a while.

Does he have to give his entire annual anti-gun, Brady Center authored, filled to the brim with lies, rant... every time there is a vote on anything remotely connected to firearms?

Sit down and shut up Senator.

Brackets mine: "It does not require gun owners to use the device [yet], and does not create any new civil liability for gun owners who choose not to use these storage devices [yet]. . . . The Kohl Amendment does not have any significant impact on current law or S. 397 itself."

Probably not intended to - just establish the new requirement in order to expand upon it later. Next, MANDATE that these devices be used, along with another "does not have a significant impact" placebo. Then, "We MUST know if the owner keeps his guns safely stored, so I am proposing unannounced police inspections to ensure everyone's safety".
