I suppose any treat we sign then becomes the Supreme law of the land...Was NATO unconstitutional?
Not all treaties are unconstitutional. Only the ones which establish an international government.
The US Constitution has in it written that only Congress has the power to declare war. Not NATO or the UN Security council. Yet who is it now that sends our boys to die in pointless foreign no-win conflicts? The UN Security council. Congress, by permitting the UN security council to determine whether we go to war or not, is committing an unconstitutional act. But the UN charter says that the Security council shall be the body which determines whether a given UN member (US included) shall go to war. So there is a conflict between the US constitution and the UN charter.
Ergo UN charter is unconstitutional. And NATO, which carries out the wishes of the UN Security Council, is by default unconstitutional as well.
Again, this is not true of all treaties, where there is a simple covenant established between 2 or more nations, and no shadowy international organization with tens of thousands of wonks paid for with your tax dollars to undermine your government's authority and your way of life.
