I hope they sue the state, as she is representing the state in this capacity, and then I hope they sue her personally!

Unfortunately, one cannot sue the Commonwealth of Pennsylvania without it's permission. Under FAT Eddie, how likely is that to be?

That's the way it is for all government lawsuits.
I highly doubt Rendell can stop it.
They file suit, a judge would certainly go along with their complaint, and either they take it to the Supreme Court and give it maximum press coverage, or they wisely agree the suits may proceed.
