Yeah, I think they have kind of avoided cases too controversial so far. There is a case that revisits part of the McCain-Feingold bill which might prove interesting.
What I think is happening, to be more precise, is that they're deferring rulings where O'Connor would be the fifth vote.
Although Brown v. Sanders is an exception to that.
