To: Always Right
I'm very surprised! For both Justice O'Connor and Justice Kennedy, the percent I came up with for agreement in full with either Justice Thomas or Justice Scalia was 76.25%. That seems low to me (obviously enough, based on my last comment). I'm gonna go do the term preceding that just to see, because I know there's been considerable commentary about how the usual T-S-R-K-O conservative wing fractured this past term.

Hmmm.. In light of this, I'd be willing to do a $100 donation to FR bet. You're in good stead, I lost my only other one a couple years ago. =) I'll get back to you with the percentages for the term before last.

Just from the opinions that are newsworthy, it seems about 75% for Kennedy or O'Connor would be about right. That would make 90% a reasonable number as a significant improvement over O'Connor and would have to be considered Roberts a great pick. And $100 donation to FR sounds good.

Its a bit early, but I am guessing Roberts is proving to be very much to the right of O'Conner and fitting in quite well with Scalia and Thomas.
