It's possible that the criminal referral was a defensive tactic initiated by the same rogue element that gave Wilson official travel orders to Niger. CIA officials at higher levels would probably not be inclined to squelch a criminal referral.
So many juicy Senatoral targets. Hah, I could only wish it would turn out to be Pat "Leaky" Leahy.

Check the "breaking news" sidebar. It seems one of her bosses at the CIA says she was NOT covert. At least, he went on record and used his name--as opposed to "anonymous sources" (which, as near as I can tell, means "voices in my head.").
I think there is going to be a shocker at the end of this case. The liberal biased media and Dems are going to go into the vapors.
Fitzgerald is persuing Joe Wilson for perjury and obstruction of justice and leaking classified information. I went back and read a Newsweak story from August 2004 about Colin Powell testifying before the grand jury. At the end of the piece "someone familiar with the investigation" said they were wrapping up the case, but the Senate Intelligence Committee had just released their report on pre war intelligence and there were some troubling things in it regarding Joseph Wilson. His public statements did not comport with the reports conclusions of Plame's involvement and they were looking into it. I think the Wilson's (both) testified before the grand jury and LIED. I imagine the investigators are wondering why Wilson waited 18 months after his trip to Niger before writing a hit piece in the NYT about it all. What was Wilson doing in July 2003? He was advising the KERRY CAMPAIGN. Is this political "dirty tricks" using classified info.
Wilson wrote that piece which was based on "classified information". His wife was not "covert" and had not been since 1997 and according to her boss at the time (per Washington Times) she had a limited roll and not a "deep under cover" status. He was scornful of the whole thing.
AS far as Judith Miller of the NYT is concerned, she is NOT protecting an administration source, she is protecting JOE WILSON. Scooter Libby (Cheney's Chief of Staff) has told the grand jury that he found out about Plame from a reporter, the same as Rove. Libby has said he talked to Judith Miller AND Libby and Rove both signed waivers to "any person" they spoke to about the case in July 2003.
Why would she go to jail when she had a waiver from Libby to talk? Because her source is Joe Wilson who wrote the "article of lies" in her newspaper, the NYT. There is a reason she never wrote about this case. I believe Wilson told her that his wife was "covert".
ALSO, ask yourself where we first heard that Valerie Plame was an "undercover agent". Answer: From Joe Wilson on the Today Show. He outed his own wife.
I believe Judy Miller will be charged with criminal contempt and Joe Wilson and maybe his wife will be charged as well. That will be sweet justice.

I think that the investigation is on the right track and is focused on persons in the media and the Democrat party who were involved in a conspiracy to frame Rove for a crime which never even happened and lied to investigators and the grand jury in furtherance of the conspiracy.

Why did the CIA send a referral?
Why is a reporter siting in jail for not diclosing a source who revealed Plame's name?
Why was Karl Rove and all these other people being investigated for leaking a name if she wasn't covert?
Why even investigate if she was NOT covert?
Yes. That's why Bush told Americans, calmly, not to pay attention to the media reports. He said wait until the investigation has ended.
