How is it legal for local municipalities to put restrictions on firearm ownership?
That's my question, too. I doubt this ordinance could stand up to a challenge ... but without originalists on the Court it might.
From Article 1 of the Ohio State Constitution.
"The people have the right to bear arms for their defense and security; but standing armies, in time of peace, are dangerous to liberty, and shall not be kept up; and the military shall be in strict subordination to the civil power."
The problem is that our Supreme Court here in Ohio tends to use the Constitution as a very rough guideline only.
