I'm sorry, I wasn't clear. Sure the possibility exists that he'll go to prison. However, since no actual financial damage was done, the chances of probation just skyrocketed.

I'd suggest just the opposite - if the prosecutors and judge look at his rap sheet (and no doubt they will), they'll see he was previously arrested for resisting arrest, etc. See the links posted above.
