Reid Not Looking For a Fight to Replace O'Connor [Suggests Republican Senator's]

As the minority leader of the U.S. Senate, Harry Reid will be power broker of sorts. Friday, Reid went on the record saying he wants the confirmation process to be as free of political warfare as possible.

Certainly. Recess appointments to SCOTUS have occurred several times, the most famous example being none other than Earl Warren.

However, as you accurately note, there is currently no vacancy to which to appoint a justice during recess.

Reid's auto response to any Republican position is obstructionist lies.

We in Nevada at least have Senator Ensign. He almost
beat Reid a few years ago. He won his Senate seat
in a later election. I have watched Senator Ensign
counteract Reid's votes on many issues. This new/old
fight will be the same once a nominee actually reaches
the Senate floor. I know this is a small point, but
every bit helps.

ahhh.....

well believe me THIS subject will be the hot button topic. there will be progress sure, but it will take a while.

Pretty much this is a slam dunk for W. however, as I have said before, even Michael Jordan blew up a slam dunk every once in a while....

You're right - I think he'd make a good Gov. That said, I like him in the Senate - he seems to be one of the cool-headed, well-spoken Pubbies. too bad he's not on the shows more.

Yah, that idea's been kicked around on a bunch of threads. Afict, he's just too old -- although he might very well find a bit of payback quite enjoyable, heh, heh, heh.

However, unless Mr. Bush wants to try to expand the Court to 10 members, there's no place to put a recess appointee.

I think Bush should do just that! Wouldn't it be a hoot? The Dems would either have to roll over or grit their teeth and fight anyway -- "she's good enough for the DC Circuit but not experienced for the Supreme Court."

But on your other point, Reid knows that he will eventually lose. If he blocks the SCOTUS replacement for O'Connor, the Republicans will use the constitutional option. Then he can hardly lift a finger to stop Rehnquist's replacement.

I think he will save his fight for when either Ginsburg or Stevens retire or die in office. Because if Bush nominates replacements for these justices, then the balance of power will REALLY shift.

Wrong. He is not his father, and he has shown time and time again that he does what he says he's going to do.

He's said over and over again on the campaign trail that he wants strict constructionists like Justice Thomas and Justice Scalia on the court.

Here is a great summary of what is at stake, guys. From my former law professor, Lino Graglia:

“...judicial usurpation of legislative power has become so common and complete that the Supreme Court has become our most powerful and important instrument of government in terms of determining the nature and quality of American life. Questions literally of life and death (abortion and capital punishment), of public morality (control of pornography, prayer in the schools, and government aid to religious schools), and of public safety (criminal procedure and street demonstrations), are all, now, in the hands of judges under the guise of questions of constitutional law. The fact that the Constitution says nothing of, say, abortion, and indeed, explicitly and repeatedly recognizes the capital punishment the Court has come close to prohibiting, has made no difference. The result is that the central truth of constitutional law today is that it has nothing to do with the Constitution except that the words 'due process' or 'equal protection' are almost always used by the judges in stating their conclusions. Not to put too fine a point on it, constitutional law has become a fraud, a cover for a system of government by the majority vote of a nine-person committee of lawyers, unelected and holding office for life.

Of course that wimpy bast*rd isn't looking for a fight, he couldn't beat an egg in a blender. He has gotten used to expecting the gentlemen Senators of the GOP, to treat his sissy @$$ in the same manner they do ladies. Not this time Maw Reid!!!!

If Bush dares nominate anyone other than the likes of, Hillary Clinton, Schumer, Max Waters, Bill Clinton, Kerry, Edwards, Jesse Jackson, Pelosi, Al Gore or one of the nags from NOW-the sh*theads will hit the fan.

Bring your buckets, Red Cross, your blood shortage will soon turn into a massive surplus.
