Microsoft Corp. agreed to pay $775 million and provide software to International Business Machines Corp. to settle a long-running antitrust dispute between the giants.
The companies said the settlement resolves claims arising from the federal government's antitrust case against Microsoft in the mid-1990s, where IBM, of Armonk, N.Y., was identified as having been impacted by certain Microsoft practices.
Under the terms of the deal, Microsoft, of Redmond, Wash., will pay IBM $775 million and extend $75 million in credit towards deployment of Microsoft software at Big Blue.
The agreement is part of an effort during the last two years by Microsoft to settle many of the outstanding lawsuits against it that have cost the company around $3 billion. The company has reached settlements with Sun Microsystems Inc. and Novell Inc., among others.
IBM and Gateway Inc. were found by a federal judge in the Justice Department case to have paid higher prices for Microsoft software than other computer makers. Earlier this year, Microsoft agreed to pay $150 million to Gateway over four years to resolve Gateway's antirust claims.
"Over the last few years we have been focused on resolving our disputes with other companies, and today's announcement takes another significant step towards achieving that goal," said Brad Smith, Microsoft's general counsel, in a prepared statement.
Microsoft and IBM said their settlement resolves all antitrust claims, including claims related to the IBM OS/2 operating system and SmartSuite products, with the exception of claims for harm to IBM's server hardware and server software businesses.
