Living in the "sue me" state of NJ, I'm actually surprised it took this long. BTW those Little Guys aren't even euligized, blessed, and buried yet!!

Only in America, but especially in NJ.

Aside from the saddest part involving the death of 3 innocents, this family will get paid just to keep this out of court.

I can go on, but I can't go on, I'll only get myself more pi$$ed.

Well, I kinda figured that's what would have happened. When there is a tragedy, sue somebody. We can't just let it go and say, it was a terrible accident. Someone has to be responsible.

Don't see how this merits a Barf Alert. The parents are angry and with just cause. The policework on this case was really sloppy.

How could the kids climb in if the trunk wasn't already open. These are grieving parents? How could one even think of a lawsuit when they just lost a child? The parents are the negligent ones surely someone should have heard the children screaming.

No doubt everyone could have done better, but if this part of the parents' lawsuit is true:

"The police were asked by the family: Did you check the car? And the family was told: `This vehicle is clear. This vehicle is fine.' . . . They were actually instructed not to go to the vehicle or into the yard because at that point it was a potential crime scene," said Villari.

The part of this story that most may not know is that the 3 boys went missing appx. 5pm. The police were not called in until appx. 8pm.

If it was so obvious to the parents that the car (which is grandma's BTW, and was unlocked!) should have been checked, then why didn't they do it themselves in the 3 HOURS prior to the police arriving on the scene?

While it may be true that the policework may have been less than ideal, do you really think that should excuse parental irresponsibility?

I don't think we're getting the whole story from the mom-in-charge.

And just how could Toyota be liable in this one?

The children apparently popped the trunk open with the lever inside the passenger compartment. They may not have been heard screaming (if they did) because there were storms in the area which probably drove everyone inside during the time when the children might have been discovered before they passed out. The really big mistake was that the police weren't called for several hours. Not that they did a better job finding the kids.

The FAMILY WAS NELIGENT! The police and Toyota should sue them for not protecting their children, costing so much and trying to tarnish their names.
