BINGO! It's amazing that you've said this, because the instant that I heard the SCOTUS ruling, I thought the same thing........that without skipping a beat, the Republican Party should instantly begin banging the drums about the necessity for a constitutional amendment to turn such an anti-American abomination around.

I hope someone smart in the party leadership is reading Free Republic right now.

I agree with you and WFTR in principle, so let's clarify how (I believe) this should be addressed on several fronts...

This egregious trampling of property owners' rights emanates from the Judicial branch of our government. Our system is designed as one of "checks and balances", therefore it is incumbent upon the other two branches - the Executive and the Legislative to perform the duties for which "We the People" elected them.

First, I would call upon George W Bush as our President to immediately assign the Justice department to investigate the issue, and to provide Attorney General Alberto Gonzales all relevant material necessary to go before the Supreme Court and argue this issue in behalf of all American citizens.

Secondly, I would also suggest that if ever there were a time for the invocation of an Executive Order, this is it.

President Bush can have Gonzales and others review the decision and the dissenting opinions and based upon their findings, draft an Executive Order for him which essentially nullifies and vacates the ruling for the good of the American people. Historically speaking, such orders have been issued for lesser reasons, so there is some precedent.

Thirdly, "We the People" must flood the telephone lines, e mail acounts, and mailboxes of our state legislators, our Congresspeople, our Senators and our state Governors regarding this issue.

We must unequivocally demand redress, support and future protection. If the rights granted to us under our state constitutions, statutes, and laws are not adequately and explicitly expressed in such a manner as to afford us a full shield under "states' rights" from the circuit and Supreme Courts, then such bills must be immediately submitted to every state legislature.

If there is a ballot initiative petition process such as in California or Oregon, the citizens themselves can address this directly, as well as seeking legislative sponsorship. In the case where there is not such an avenue available, our representatives must propose such bills.

In states where there are receptive Conservative Republican Governors, the citizens must call upon them to use the "bully pulpit" of their governorship for this cause by speaking out, proposing the aforementioned protections, even assigning the State Attorney General to draft the necessary legislation or proposed amendments to the state constitution.

On a national level as well, our Senators and congressfolk must immediately propose legislation which will render this SCOTUS decision impotent, and Bush must strongly advocate for it, and make clear his intent to sign it into law. If the Executive and Legislative branches work together, they can make the Judiciary irrelevant in this case.

Finally, every single RINO and every single leading voice amongst the DemocRat obstructionists who have contributed to the blocking of President Bush's judicial nominees must be specifically, directly, and inextricably tied to this issue and this court decision, and held accountable for it loudly, repeatedly, and continuously from now until their coming election.

They must be branded by this and targeted for defeat because of it. This MUST BE the linchpin issue, the crux of the public debate during the campaign, the central theme of, and litmus test for any Conservative candidate who would unseat them.

With an unshakeable 60 vote plus majority (better 65) in the Senate and voices like Boxer, Durbin, Reid, Schumer, Pelosi, Wrangel, and Clinton, and RINO's like Chaffee and McCain voted out and thereby silenced and neutralized - the last two years of Bush's "regime" can be among the most productive two years of any U.S. President in a hundred years.

Our District, Circuit, and Supreme courts could be returned to us, meaningful reform of Social Security and Medicare might be accomplished, benefical tax cuts and reforms might be reaffirmed/made more permanent...

Perhaps even educational reform could be addressed by way of tuition tax credits, vouchers, and other means of putting choice and control in the hands of parents, and taking it away from the Liberal teachers' unions.

All Socialist Senators, Congresscritters, and Supreme Court Injustices must GO!

This is quite possibly the worst and most dangerous decision since Roe v Wade - potentially even more damaging consequences. Right now there is a lot of shock, complaining, and handwringing, but not much discussion of constructive problem-solving (we here on F.R. can handle that.)

I advocate a simultaneous, multipronged attack against this Judicial abomination. No single avenue will succeed, but pursuing all these things I have proffered will ensure we live to fight another day.

Remember about my Exec. Order, US Att'y General litigation, and federal legislation suggestions, and my state-by-state approach as well.
