How is legislation at the state level going to do anything? Cannot the crooked local govt simply sue in Federal Court and overrule any legislation?

The supreme court ruled it was up to state laws to decide whether eminent domain could be used for private property. They didn't say it was ok or not ok just that it was not something within their juridiction to stop, and that it was the decision of the state court, and state laws. It's a states rights issue. Eminent domain differs in each state.

The Supreme Court decision did state explicity that the state did have the right to limit this activity it becomes an excessive burden on the lan/home owners of the state,
