This just in.. jury has come back with acquittal on all counts.
What little I know about Thompson leads me to believe he's a ..well, I hate to disparage someone I've never met. Let's just say he's dabbled in many ill-advised schemes and tactics, none of which are part of Joe Banister's arguments. I've made it a point to follow what goes on, but I'm no expert by any stretch.
I just finished reading D. Cay Johnston's (NYT) spin. Boy, can he rewrite history.

That sentence is proof that your reading comprehension is severely deficient.
The acquittal of the scam-artist Banister for preparing and conspiring to prepare false tax returns, has ABSOLUTELY NOTHING TO DO with the "chartered reality" of the IRS, whatever that is.
Obviously you don't know that, by law, the IRS is part of the U.S. Treasury Department, and that fact certainly wasn't an issue at Banister's trial.
BTW, Banister's client, Al Thompson, was sentenced to 6 years in prison for those false returns which Banister prepared and Thompson filed. Thompson's separate trial was about a month ago.
Banister, lowlife scam-artist that he is, allowed his lawyers to call his convicted client, Thompson, a liar during the trial.
Why was Thompson convicted? Because he followed Banster's advice and filed false returns which Banister prepared for him.

Al Thompson is a kook of the first magnitude. Banister is a scam-artist who takes advantage of kooks like Thompson by giving them ridiculous advice which winds up putting them in jail.
He also sells about 100K a year worth of tax protester BS in the form of seminars, books and tapes, and he claims TO BE PAYING THE TAXES on that income.
He tells his idiot customers one thing, then does something else contrary to that advice himself.
He is the very definition of a scammer.
The also didn't mention the fact that California is in the process of pulling his CPA license.

Perhaps the prosecutors did a poor job, but who knows why juries, especially California juries, do what they do.
Banister's real problem will arise if he's indicted for willful failure to file for 1999-2002. This trial had nothing to do with his own returns (or lack thereof).
Meanwhile, IRS/DOJ will probably try to enjoin him from selling his TP garbage to the public.
Nope and nope.
First, that would be the claim of Banister's own attorney. Banister's lawyer is the guy who let the cat out of the bag that Banister, who tells others their taxable income isn't taxable, is paying money into a trust which names the IRS as irrevocable beneficiary.
Second, the jury made no determination about Banister's taxes or whether or not he has paid them.
This trial was about Banister's preparing false returns for THOMPSON and whether Banister and Thompson conspired to do so.
Thompson, in addition to being in jail, owes about $250K plus penalties and interest. He still owes it, regardless.

Funny, all of the mindless high-fivers and TP-types have disappeared from both threads. They just don't seem to have anything further to say about ol' Joe. Perhaps they're disappointed they won't be able to visit him in jail.
But, take hope, Banister admirerers. The wheels of justice may grind slowly, but they grind exceedingly fine. I think I can hear them grinding even as I type.
