I don't believe you have any grounds for maintaining that this proposal would not hold up in court. Some states already have similiar protections. Remember the picture of the little house surrounded by a multi-story luxury hotel because the little old lady wouldn't sell and they couldn't take it. Part of me is just being a pessimist today, but look at the recent court rulings. The SCOTUS has decided it can and will ignore state laws (the recent marijuana case).

A municipality would have to sue the state in federal court (Kind of hard), but the big trick would be to get a test case.

I do remember that case in New Jersey.

This is not an erosion of our private property rights - this is a full scale avalanche - how do these people sleep at night?

My state, fortunately, is one of the few that wont allow this theft - "We got guns!"- but the big boys could always take their takeover case to the SCOTUS and win anyway.

As well, Frist needs to go! He will never get a spine and there is no more time for foot-dragging and lily-livering. He can not deliver the goods and the dems know it, They revel in making him back down, which he does so d*mn easy.

We need him OUT NOW - and put in someone Bush and the rest of can can count on to pound the gavel. We need to get in the right supremes NOW - the clock is ticking and the dems are having too easy of a time running it out to Nov 06/

It has been the most disheartening thing to watch this rabid minority RULE! (Hillary must be holding some really bad stuff in those pilfered FBI files!) We need to replace Frist and the other turncoats with people that were not in office when Hillary stole those files - someone not so easily cowed over and over with the appearance of being held in abeyance by blackmail!

We need to get our heads out of the sand and face the reality that there are some mighty EVIL people at the helm in DC - who will stop at nothing to subvert this country into socialism...and we need to do it YESTERDAY.

Frist is a nice guy - but "nice guys finish..." WE have waited and waited - and lost and lost. It's time to replace him - he is not up to the position. He is TOTALLY and utterly cowed by the dems.
