Can a recess appointment be made? That's what its gonna take given obstructionism of the dem zealots.

I predict that the next "tradition" that the Democrats will break is that we have to have 9 members on the Supreme Court.

I think they'll scour history for times when we had less than a full Court, even going back before the tradition of 9 judges. Maybe they'll even say that there's nothing in Constitution specifying the number of Justices, and they'll move to not replace a Justice at this time.

Maybe they'll even go so far as to bring back impeachment talk, and then claim that Bush shouldn't name a new Justice until these other issues are first resolved, then they'll stall and obstruct and delay.
