"Lawyers dislike such things, because.."

Most of these lawyers are unfamiliar with the Law of Land Warfare which they despise thinking it is a lower form of law.

Most people familiar with it refuse to recognize it is an agreement not a disembodied principle floating in the ether. These people are not a party to it, never recognized it, never acted for a state that did. It has nothing to do with any of it. We voluntarily treat them decently because we freely choose to do so. We may freely pick a standard stated in some law, but not because it is any law between us and them, or binding on our conduct toward them, in any way. If we shot them as soon as we captured them, moral leaders might rightfully condemn it. But no law would have been broken, because we never agreed and they never agreed to anything at all in the matter.
