Section 1: The Federal government can make any rule it pleases on any action that could have any effect on interstate commerce, no matter how penumbrally.
Section 2: Everything done or not done affects interstate commerce.
I stand corrected. The reasoning behind this case is horrible. I completely disagree with it, and hope that it is overturned in dome farr-off future day (same with Wickard v. Filburn for that matter).
Exactly. The primary effect of this ruling (and subsequent lower court rulings citing this one as precedent) is that Congress rather than State Legislatures get to determine what is a crime. Sort of like the 55mph speed limit.
