Too many "conservatives" believe that the government should only stay out of their business. The other guy, that's okay so long as you stay away from me.

Too many "libertarians" are only unhappy with federal judicial oligarchy when it doesn't accrue to their favor.

I'll agree that there are hypocrites everywhere. Doesn't make it right.

And on this specific matter, it's the so-called "conservatives" who are advocating federal supremecy over state laws.

Everybody seems to suffer from that particular blind spot these days - "judicial activism" has been reduced to "whenever a judge makes a decision that I (we) don't like". Sigh.

I don't believe that at all. I know the arguements for upholding the laws passed by legislatures, etc. But if the laws passed by legislatures are un-Constitutional then what's a justice that's sworn to uphold the Constitution to do?

I think Thomas is the best justice there is just slightly ahead of Scalia. Of all of our justices, Justice Thomas seems best to understand original intent of the Constitution and that means a lot to me as someone that thinks we will never see a day were we start slouching back towards original intent. We're forever going down this road that throws the Constitution out the window, we have been for well over 70 or 80 years (probably longer).
