Rush Limbaugh successfully kept his medical records sealed to prosecutors investigating whether he illegally purchased painkillers - at least for a few more days.
Circuit Judge Jeffrey A. Winikoff decided Thursday to transfer the sealed records to another judge, who will decide how prosecutors will review them. Limbaugh has lost repeated court battles to keep the records sealed, but his appeals have successfully stalled the investigation for more than 18 months.
It was not clear Thursday when the second judge might issue a ruling.
Limbaugh's attorney, Roy Black, has urged the court to privately review the records before handing over approved portions to prosecutors. He insists that the records contain privileged information on matters unrelated to the state's investigation.
Prosecutors say the records contain information that Limbaugh engaged in "doctor shopping," or illegally deceiving multiple doctors to receive overlapping prescriptions.

Not necessarily. If the prosecutors use them illegally, the case can be decided in Limbaugh's favor by that fact alone. However, I am not a lawyer (THANK GOD).
But .. if they had found anything from their illegal snooping while they had the files .. don't you think they would have revealed it by now ..??
These people are so LUSTING for something damaging to pin on Limbaugh - they would not have been able to keep something like that quiet.
My 1st question is: Why the change of judges ..?? Different court jurisdiction ..??
My 2nd question is: When is a change of judge required ..??

CyberAnt, I disagree. They would much rather have Rush prosecuted in their own court than in the court of public opinion. So I say that if they have anything, they're damn well going to make sure it's not reversible on appeal.
The short answer: Roy Black asked for it.
The longer answer: The case is going back to the original judge who approved the search warrant to seize Rush's medical records. The appellate court suggested this scheme.
The original judge will read all the records and black out any portions not relevant to the criminal investigation. Then he will turn over the redacted records to the prosecuting attorney in a couple of weeks.
If the prosecutors can do this to Rush's records, somebody should check out Ted Kennedy's secret detox records from Chappaquidick on.
And .. why would Black do such a thing ..?? What purpose ..??
Isn't the original judge a Clinton appointee ..?? And who's going to check and see what he redacts and what he doesn't ..??
Will Black be able to see the redacted documents before they are turned over to the CRIMINALS ..??

But .. I'm convinced Hillary has her fingers in this pie .. and she is known for her "gotcha" attacks, and jumping the gun with any HOT information .. instead of looking ahead.
I would think this is in State court, not Federal.

This may have been the approach Rush used, and it may not have helped him, due to his public profile.
But it should work for "most" of us.
Oh .. so he would have been elected or appointed by the Gov of FL ..?? Judge Greer was elected - by liberals.
Just pointing out that if he is a State Court judge, Clinton didn't appoint him. I don't know anything about him other than that.

Clinton has never been a Florida governor. Furthermore, Florida circuit court judges are elected officials.
