The failure was a srategic one. Frist allowed the dems and MSM to spin this for weeks on end. He should have not hesitated so long before pulling the trigger. Absolutely. Time is on the Dems side, with the MSM trying to whip up support for abuse of the filibuster. Once public opinion rolls towards the Dems, the nuclear option becomes politically unviable, and the minority party takes charge of the Senate.
