It will be interesting to see if the 14 can hang together or not. I would guess that Linsey Graham has sealed his fate in SoCar. He was very foolish to involve himself in this. Imagine how he will feel when Bryd loses in 2006.

Here's an informed opinion: Bush will very quickly nominate Mike Wallace, a lawyer from Mississippi and former Rehnquist law clerk, to the Fifth Circuit.
The Dems will freak because Wallace was Trent Lott's counsel for the Clinton impeachment- as conservative as they come.
Aren't you being a bit EXTREME. There must be some strategery involved. Certainly, no Republican can be dumb enough agree to a deal like this, if there is no bigger victory lurking around the next bend in the road. Relent! Continue to give to the RNC! After all, if it weren't for the Moderates in the Senate refusing to convict Der Schlickmeister, we would be starting the 2nd term of President Algore and with all the comity shown by Senate Pubs, who knows what the courts would look like.
How could you move for a rules change without a filibuster? And, as I told you, enough Dems would have voted for cloture to prevent a filibuster and preclude an opportunity to introduce a rules change motion.

Actually, the US Constitution provides for the US Senate to make its own rules. It's Article I, section 5, clause 2.

The GOP Senators did not want to change the filibuster rules. I don't blame them, IF THEY INTEND TO FILIBUSTER FUTURE DIM OUT OF THE MAINSTREAM JUDICIAL APPOINTEES. That to me is the implied long term promise.
That is what they got. If for giving up two of the seven, they kept their right to filibuster future Dim radical left appointees AND THEY USE THAT RIGHT, then it is not as bad a deal as some make it out to be. In addition, I think Bush should now reappoint Estada and then appoint him to the US Supreme Court in June.
