Besides it was also stated that the three judges were not to be filibustered. All three were filibusters on strictly political grounds to do so again would clearly break the agreement.
Were this not so the agreement would not be worth the paper it was written on. The Republican Senators that signed it said the agreement would not allow for filibusters based on politics.

The Republican Senators that signed it said the agreement would not allow for filibusters based on politics.What they said is different from what they signed. Written words trump oral ones in Contract Law. They've set themselves up to be shredded one way or the other.
