If the republicans compromise on this and waive the right to end the filibuster (under any circumstances), we will end up with no choice but to appoint only justices approved by Ted Kennedy. If that happens, we have a leftist court for the next 20-30 years and it's not clear to me that the Republic will survive that.
We have a rare opportunity here that will likely not last--Republican control of the Senate and the Presidency. If we do not take advantage of it now, it's not going to be there to take advantage of in increments in the future. Unfortunately, change on the supreme court requires genuine conservative judges with a principled devotion to interpreting the Constitution as it is. Mere 'solid Republicans' have proven over and over that they will drift to the left and end up part of the leftist majority on the Court.
I do not believe there is even a close second issue. Without control of the Courts, very little the other branches do will have lasting effect. With control of the Courts, an incremental approach on other issues works.
So to put it bluntly, I have joined my radical brethren on this one. The Republicans have to deliver a scorched earth, a you-don't-get-any-pork-ever-again, a 'President Bush will support someone else in the primary next election and you will get no funds from the RNSC' type effort on this. One of the spinless six will yield to that sort of effort. If I don't see clear evidence of that type of effort, my contributions to the national party cease and I will resign my party position. It's that important and if we don't win it, all the other incremental victories will be largely meaningless.
Another, more practical, problem. I ran hundreds of volunteers in 2004 walking precincts and making calls. I talked to most of them. The number one issue for 90% of them? Judges. If the Senate Republicans blow this one, I will have a very hard time getting volunteers for 2006. That makes this issue a discontinuity in another way. Win and our electoral margins will likely increase even more next time because we have the manpower to GOTV. Lose and the opposite occurs."

You know, even Pat Buchanan, who as you know ran against President Bush in 2000, voted for him in 2004.
Buchanan said the reason was the judiciary.
I was listening to the radio and someone said that leftist groups are targeting wavering senators re: Constitutional option. Unfortunately, the only names I caught were Senator Mike DeWine (OH) and Senator John Sununu (NH).
Whether they are from your state or not, you can call them toll free at 1-877-762-8762 and tell them to vote for the Constitutional option, and no compromises, please.
You can also use the toll-free # to tell Senator Frist to continue his fight and not compromise with Dems.

Of course, I'm paraphrasing, but Sean said he heard that the Republican "moderates" want to deal with Dems that two nominees won't go to the floor for an up or down vote, and GET THIS - Dems can filibuster whomever they want regarding Supreme Court nominees if they are not "acceptable." Of course, the Dems won't think anybody that interprets the Constitution is acceptable.
As for the two nominees, of course, the Dems will pick the best we got, to filibuster.
Sean says Republican "moderates" need to have courage and should not compromise with Dems and the Constitution should not be compromised.

The last I heard the key GOP Senators are John Sununu (NH), Collins (ME), DeWine (OH), Hagel (NE), Murkowski, Specter (PA), Warner (VA), and maybe Lindsey Graham (SC). Frist can afford to lose only two, because McCain, Chafee, and Snowe have declined to end the judicial filibusters.
