Charge Added Against Woman in Wendy's Case

San Jose -- A woman accused of lying about finding a human finger in a bowl of Wendy's chili was charged Wednesday with conspiracy to commit fraud, adding to the theft counts she already faces.

Meanwhile, a woman provided more details about how the finger may have been lost. She said her son lost the finger in a work accident and gave it to the suspect's husband to settle a $50 debt.

"My son is the victim in this," Brenda Shouey told the San Francisco Chronicle. "I believe he got caught in something, and he didn't understand what was going on."

Anna Ayala, 39, who already faces attempted grand larceny and grand larceny charges, told police she discovered the fingertip March 22 while dining with family at a Wendy's in San Jose. Police arrested her and accused her of making up the story to extort money from the fast-food chain.

Prosecutor David Boyd added the conspiracy charge during a hearing Wednesday, saying Ayala "conspired with her husband and possibly others to commit a crime that involves manipulation, lies and most importantly deceit for no other reason than to line her own pockets."

Ayala had hired an attorney following her alleged discovery, but a lawsuit was never filed.

This is a very good opportunity for the state to make an example of this woman and provide a deterrent to others. Frankly, deterrence is the only way to keep this sort of thing from happening all the time, at a huge cost to society-at-large. If this woman escapes severe punishment, it will be open season on every successful business in this country.

The best thing about this is her career as a professional plaintiff are over.

NO ONE will ever believe any claim from her henceforth.

Put her in prison....where she will no doubt take up the popular hobby of filing frivolous lawsuits over things like not enough pudding cups for dessert

LMAO What kind of people are they raising in California, The man takes this guys finger in payment for a $50.00 debt and then they dump it in a bowl of Wendy's Chili and sue. I knew California was the land of fruits and nuts, Most of the fruits lodging in sanFrancisco, but it seems the nuts are spread all over the place.

I wonder if this woman sits in jail shaking her head at her own stupidity. She thought she was on E-Z Street on March 22nd. and look where she is now. I wonder if she realizes, just like the guy with the missing finger part, there is just no point to it.

I was having a cup of chili in Wendys the other day, and I thought at the time that now Wendys could put all the fingers and toes or anything else in their chili that they like and no one could say anything. Tee Hee.

Even if we find a legitimate foreign object in some restaurant's or the other's food, no one would believe us. Tee Hee.

Darn lucky for the son that his mom didn't owe them $500, at $50 per finger.

"...in California..."

The perps and the finger came from Nevada. The crime was committed by perps after they came to California (San Jose). And yes, California is full of nuts and fruits.

"...and look where she is now."

This woman cost Wendy's millions. If she still has any assets left from her previous scams, Wendy's can take those in court.
