Orange County state senators split along party lines last week on a bill to ban gay marriage.
Sen. Bill Morrow, R-Oceanside, sponsored SCA1, a proposed constitutional amendment to mandate that only marriages between man and woman are recognized in the state.
Morrow, whose district includes San Clemente and San Juan Capistrano, cited the support of 61 percent of voters for Proposition 22 in 2000, which recognized only male-female marriages.
In March, a San Francisco Superior Court judge declared the law discriminatory and unconstitutional.
Morrow presented his bill before the Senate Judiciary Committee, chaired by Sen. Joe Dunn, D-Santa Ana. Dunn and the committee's four other Democrats voted against the bill, citing the judge's decision, among other reasons.
Morrow and Sen. Dick Ackerman, R-Irvine, were the only "yes" votes. An identical bill went down to defeat in the Assembly Judiciary Committee on a party-line vote, with three votes for and six votes against.
Morrow said the vote illustrated the Legislature's disregard for public sentiment.
He vowed to fight on and support efforts to place a new initiative on the state ballot.
"It is important to recognize that homosexual activists fired the first shot on this issue," Morrow said. "They had the ability to do whatever they wanted in private nearly every single right that married couples maintain, through domestic partnerships but that was not enough. They wanted social acceptance of their lifestyle through the legal institution of marriage."
