He was in Israel, so it wasn't illegal.

You have to read all the way to the second to last paragraph to find this:
DeLay's smoke...did not violate U.S. regulations
To: West Coast Conservative
Yeah it was legal. I think the point was he was smoking a Cuban after he previously said "Every dime that finds its way into Cuba first finds its way into Fidel Castro's blood-thirsty hands."

THIS JUST IN:
The New York Times has confirmed through highly placed, inside sources, Republican majority whip Tom DeLay has icky toenails.
Fellow Republican Chris Shays recommends the leader step down.

He was in Israel, so it wasn't illegal. Wrong its even more illegal now that bush decided he owned every american citizenUS tightens ban on Cuban cigars
From the link For example, Americans are barred from buying a Cuban cigar in other countries, even to smoke it outside the United States.
"The question is often asked whether United States citizens or permanent resident aliens of the United States may legally purchase Cuban goods, including tobacco and alcohol products, in a third country for personal use outside the United States," the notice said. "The answer is no."

Out of country would not be breaking any laws, and if this is the best the demoncrats have at this point, they are in trouble.
