Ideally, sure. But there was a reason that this law, and labor law, and OSHA and the like came about. They may not all be optimal solutions, but I wouldn't want to live in a country where they didn't exist at all.

I really can't see gubmint getting involved in personal situations like this. It should be up to the employer whether or not to offer something like this, and what to do with the shortage of help while someone's on leave (although I tend to think companies have too many workers these days, and if someone's gone the other workers can take up the slack; that's how you can tell if you have too many workers!).
