Ana Ayala is being charged with Grand Larceny. The San Jose Police Department has scheduled a press conference tomorrow afternoon at 1 pm.

When I went through Wendy's drive through tonight I asked her if I could have a finger with a diamond ring on it? LOL She laughed.

I'm glad they arrested that woman. I thought it was a hoax from the beginning. People don't get their finger chopped off and just ignore telling their boss. At that point, they would have shut down the machines, and all the food would have been destroyed at that point.

from what i know to be charged with grand theft the value of the item has to be over 100.00 and unless the women who orginally had the finger had one hell of a expensive bottle of gold dust nail polish i really dont think a 1/2 inch finger gets that much on the open market :-)

Apr. 21 (ABC7) — There's a new development in the investigation of a finger found in a bowl of Wendy's chili last month. San Jose police confirm that Anna Ayala, the woman who reported the finger in her chili, has been arrested in Las Vegas

Police are not saying what charges have been brought against her.

Ayala's sister, Mary Ayala, tells ABC7 that she was arrested on grand theft charges.

San Jose police say they will provide more details at a news conference on Friday.

Thirty-nine-year old Ayala is the Las Vegas woman who claimed she bit into a human finger found in her chili at a Wendy's restaurant in San Jose on Mar. 22.

Suspicion fell on Ayala when police and health officials failed to find any missing digits among the workers involved in the restaurant's supply chain.

The most curious turn yet in the case led to a dead end last week, after the owner of a Texas animal refuge called Wendy's hot line to say she remembered seeing a leopard being kept as a pet bite the fingertip off a Nevada woman.

"What are the odds?" asked Carol Asvestas, who runs the Wild Animal Orphanage in San Antonio.

The victim, Sandy Allman, lost the tip of an index finger in February when she was bitten by a spotted leopard, one of several exotic pets she kept around her trailer in Pahrump, 60 miles west of Las Vegas.

She said the fingertip - which apparently disappeared in the hospital where she was treated - seemed identical to the digit Ayala chomped on. However, Nye County Sheriff Tony DeMeo announced that "the Pahrump connection is diminishing" after learning that Allman lost a mere fingertip.

Ayala hired a lawyer and filed a claim against the franchise owner, Fresno-based JEM Management.

"Lies, lies, lies, that's all I am hearing," Ayala said. "They should look at Wendy's. What are they hiding? Why are we being victimized again and again?"

But after police searched her home in Las Vegas and continued to question her family, she decided to drop the lawsuit threat, saying the whole situation was just too stressful.

As it turns out, Ayala has a litigious history. She's filed claims against several corporations, including a former employer and General Motors, although it's unclear from court records whether she received any money. She even said she got $30,000 from El Pollo Loco after her 13-year-old daughter got sick at one of the chain's Las Vegas-area restaurants. El Pollo Loco officials say they didn't pay her a dime.

The San Jose police fraud unit joined Las Vegas police in the search of her home there, and officers have questioned her family members in both cities. A family friend, Ken Bono, 24, said the warrant indicated police were looking for a cooler, a blue bag and "any family documents about anybody dead."

Rumors swirled that police also were looking for a dead aunt -- until Bono acknowledged two days later that he made up the story because the family was being hounded by media.

Earlier today, Wendy's announced it had completed its internal investigation of the incident and said neither the company, nor its suppliers had anything to do with the finger.

Executives say the fallout has cut profits at some Bay Area franchises by as much as 50 percent.

Wendy's is trying to lure customers back by offering a free junior Frosty to anyone who visits one of their Bay Area restaurants this weekend.
