"Also, how do you, and others, 'know' what DeLay knows?"

The same way DeLay knows how Kennedy uses the internet. :-)

"So ... back to your question ... "cruel and unusual" can be defined by looking at how it has been applied for over 200 years."

The definition and who it applied to varied by state so there was no "one" standard for 200 years.

Consider too-
"Britain influenced America's use of the death penalty more than any other country. When European settlers came to the new world, they brought the practice of capital punishment. The first recorded execution in the new colonies was that of Captain George Kendall in the Jamestown colony of Virginia in 1608."

So why not include Britain, an int'l country when researching the death penalty?

Too, "Moratorium on executions
By the end of the 1960s, all but 10 states had laws authorizing capital punishment, but strong pressure by forces opposed to the death penalty resulted in an unofficial moratorium on executions for several years, with the last execution during this period taking place in 1967." This is not 200 years.

Were it uniform all of the means to carry out the penalty would be the same.....it varies because of the differences in the interpretation of cruel and unusual. Chemical death hasn't even been around for 200 years.
