If by treason you mean treason against the US, it probably won't happen. Most likely he is an Iraqi citizen. Many networks use local cameramen for certain assignments.

If he is an Iraqi and in civilian clothes he could be considered a spy and executed. Espionage is probably easier to prove than treason.
And may I ask....How long until the ACLU raises its scabrous head (and other parts)?
