Officials: Man not held against his will

TUCSON, Ariz. - Authorities determined Thursday that three volunteers involved in a civilian project to watch the border and report illegal crossers did not hold an illegal immigrant against his will.

The Mexican man had told sheriff's deputies that he was detained and forced to pose for a picture holding a T-shirt with a mocking slogan. The shirt read: "Bryan Barton caught an illegal alien and all I got was this T-shirt." Barton was one of the three volunteers.

"The county attorney's office reviewed all available evidence, that indicates that there was no forcible detention, therefore the case is not substantiated, and no charges are pending," said Carol Capas, a spokeswoman for the Cochise County Sheriff's Department.

The sheriff's department, Mexican Consul Miguel Escobar and the U.S. Border Patrol also agreed that the 26-year-old man was not detained, said Capas and Border Patrol spokeswoman Andrea Zortman.

The volunteers involved in Wednesday's incident identified themselves as members of the Minuteman Project - a monthlong effort that has people from around the country spread out along a stretch of the Arizona-Mexico border to report undocumented migrants and smugglers.

Law enforcement officials have said they fear the project will lead to vigilante violence. Mexico's foreign relations department also pledged in the days leading up to the civilian operation to pursue all legal and diplomatic means to stop the volunteers and ensure that they do not violate the rights of Mexican citizens.

Wednesday's incident was the first reporting any possible detention, though volunteers earlier assisted an immigrant in distress.

Gee, so the illegal alien lied.

So did Martha Stewart and look what it got her. This seems to be another example of illegal aliens having superior rights under the law to American citizens. It seems there is almost no law they can't break with impunity.

I know a couple of supply sergeants that would take umbrage at being called old, and fat, even though they are 57.

As for your assertion that I am "OK with exempting individuals from the consequences of hiring illegals or hiring companies that employ illegals", that is a complete and utter fabrication on your part that in no way is reflective of anything I have said in the above post or in any other.

Well it sounded to me like you were covering up or making excuses for Tancredo because he didn't have the resources (human resources) to check out the people he was hiring. I wasn't sure if you wanted to extend that cover to anyone, or create a special privilege just for Tancredo.

My brother is not an organizer of the MMK. However, it appears that 'Minuteman rally organizer Bryan Barton' is. It's disgusting behavior even if he wasn't charged.

I have been pretty clear and consistent in my opinion on hiring illegal aliens. Anyone, from a housewife wanting a maid to a multibillion dollar company hiring a cleaning crew that knowingly hires illegal aliens should be prosecuted to the fullest extent of the law. All of them. Every time.

The distinction between a company like Wal Mart and an individual (any individual), is that large companies have HR processes in place and contracting policies that should be able to determine the status of employees. They check SS numbers and have experts that can detect fraudulent documentation.

Because of the illegal alien industry, there are now many lawless ancillary industries, and document forgery and identity theft are among them. This makes it more difficult and costly for a small business to verify and validate fraudulent documentation and identities. Only recently has the Federal Government made it easy to verify SS numbers, and this program is still voluntary, not mandatory, before someone is hired.

I don't have to make excuses for Tancredo, because no one anywhere has been able to prove that either he or the reputable business he hired had any knowledge that the 2 individuals claiming to be illegals in the Denver Post hit piece were knowingly hired as such, or even that they are actually illegal aliens. The business Tancredo hired provided appropriate documentation disputing any claims that they had hired "undocumented" workers.

Fukunaga said he has documents on file showing that each of the company's 15 employees is legally entitled to work in the U.S. The documents vary by employee but in some cases include copies of Social Security cards and driver's licenses, he said. When asked to show copies of those documents, he declined."
