The repeated failures by the 9/11 Commission leadership to deal adequately with national security secrets that Berger stole and destroyed, with the Gorelick conflicts of interest, and with its catering to partisan agendas to ensure a consensus at the expense of a thorough assessment of the facts shall forever undermine the validity of the Commission's (initial) recommendations.

If the Kean and Hamilton had any real concerns about our national security, our intelligence apparatus and their reputations, they would be hitting the talk show circuits again, demanding explanations from Berger about what he was hiding and cleaning up their former negligence.

Kean and Hamilton are part of the affliction of liberals that blind them to realities. Adherence to the doctrine of political correctness and a willingness to whitewash wrongdoing by their comrades means they will never uncover the true causal factors underlying a societal or governmental problem.

Failing to be able to discuss problems honestly to gain an understanding of root causes consigns liberals to learn the wrong lessons, to apply the wrong solutions, and to lose elections through incompetence.

This recalls Albert Einstein's definition of insanity: "Doing the same thing over and over again and expecting different results". (This should not be required reading for "Hollering Howard" Dean. -- ed.)

I always thought that the Clinton Administration billed
itself as "The Most Ethical Administration In History".
Are they now suggesting that the word "Ethical" be replaced
with "Disorganized"?

More than a few conservatives have been crying foul, or whitewash, in part because Mr. Berger's plea means he'll likely avoid jail and lose his security clearance for only three years. So we called Justice Department Public Integrity chief prosecutor Noel Hillman, who assured us that Mr. Berger did not deny any documents to history. "There is no evidence that he intended to destroy originals," said Mr. Hillman. "There is no evidence that he did destroy originals. We have objectively and affirmatively confirmed that the contents of all the five documents at issue exist today and were made available to the 9/11 Commission."

It's worth noting that Mr. Berger will still have to explain his actions to a judge at sentencing -- a judge who could reject Justice's recommendation and give him to up a year in jail. We hope the judge does insist on a full explanation of motive. Lesser officials have received harsher penalties for more minor transgressions, so a complete airing of the facts will show the public that justice is being done. But given the minimal damage from the crime, this looks to be a case where prosecutors have shown some commendable restraint against a high-powered political figure.

I deal with the Bush Justice Department every day, and nothing has changed since the Clinton Administration; they are still out kicking the crap out of farmers, ranchers, and miners.

As our beloved (or scorned, depending on your point of view) Rushbo always loves to say..."follow the money"!

I was fascinated with an discussion yesterday on the Fox, with the Judge (Neopol??). I heard them discussing the "Patriot Act", which was knee-jerked into place by the Congres, and signed quickly on TV by Prez Bush. (Where did it come from?)

As of this writing, it has NOT BEEN USED IN A SINGLE CASE OF NATIONAL SECURITY! It HAS been used as a tool in corruption, pronography, and prostitution cases. The "sneak and peek" and some other egrigious issues are imbedded, but the judge thinks that a "knowledgable" Supreme Court could not hold it in compliance with the Constitution IN ANY WAY!

Of course, they gave us Roe... as well as stop and sniff!

The modern terminology distinguishes between mild, moderate, severe, and profound levels of retardation. Historically persons with mental retardation have suffered legal disabilities (as in not being allowed to marry or vote). Generally today, an adult with mental retardation who is his or her own guardian does not suffer these disabilities.

This is a fact: The judge has not accepted the plea deal yet and Berger has agreed to cooperate.

I, contrary to those who seek to bear false witness against others, have never said I expect Berger to "rat" on the clintons. I have said the deal is contingent on his cooperation and I have encouraged others to ponder the implications of what and why he is cooperating if this deal is done and tied up with a bow.

Sentencing set for July 8.

Just the facts, which last I checked, still matter.

Why do clintonoids loyally serve their masters and take the fall when necessary? I think they got in in the first place through greed. They are drawn to power and fail to recognize the dangers of climbing the slippery pole, as Disraeli called it.

Why do they roll over? Because otherwise they would be dead. History is clear enough on that point, as Vince Foster and Ron Brown could testify if they were still around.

It remains to be seen whether this show is over, or whether the canary may yet sing. Personally, I doubt it, but we won't know until the judge brings down his gavel.

Calling the theft of top secrets a misdemeanor is laughable, but perhaps Morris is right that it puts an end to any future political career. If so, the punishment is reasonably severe.

One point still bothers me. "Yes, the documents Berger purloined were not the only copies," Morris says. But we really don't know that. What the authorities say is that Berger stole several different copies of the same document. That seems to mean several different working drafts. We don't know for sure that they weren't the originals, or that the library still contains copies of all of them.

Remember that the first thing security officials did when they realized Berger was stealing documents was NOT to call the FBI but to call Berger's lawyer. In other words, seemingly they were working more with Berger than against him. Their job was NOT to first notify Berger that he had been caught, but that's exactly what they did. Whoever was responsible for doing that should have been fired.

Are we all equal under the law, or AREN'T we???
I guess we know the WSJ's answer to that question.
