This is a state's right issue. Now is the time for us to start reviewing our own state's law and working for a change if needed.

Generally, I agree with you. Yet when a state law or judicial decision compromises Constitutional rights, I would expect Federal intervention.

Greer's interpretation of clear and convincing doesn't seem to pass the common sense test and did show that the Florida law needs fixing or risk further cynical application.

People have a right to give up their Constitutional rights.

You can give up your Fourth Amendment rights and allow the police to search your house without a warrant.

You can give up your right to counsel.

Etc, etc...

I can't argue with you. But we have seen totally intrusive Federal intervention, usurping state rights and judicial decisions this past decade go unchecked and violated. Just depends on who as at the wheel.

The only answer I can come up with is if the American people don't get their butts in gear soon, we're hosed.
