Judge rules with DCF over Schiavo records

CLEARWATER, Fla. A Florida judge is keeping some records of investigations into Terri Schiavo's treatment out of the hands of the media.

The St. Petersburg Times wanted access to summaries from the state Department of Children and Families. The agency launched dozens of investigations into complaints that the brain-damaged woman was mistreated.

Some were based on bone scans showing Schiavo suffered fractures. Others were based on statements she made to family and friends that she was unhappy in her marriage.

Schiavo's husband has denied harming her.

Circuit Judge George Greer has denied the request -- saying the records belong to D-C-F. He says Schiavo's husband can have access to them, but they can't be distributed publicly.

The agency didn't want the records released -- saying it would hamper an ongoing investigation.

A similar motion filed by the parent company of The Tampa Tribune is scheduled for a hearing Monday.

How long will this investigation go on? Another fifteen years? I'm not inclined to cut them much slack at this point.

Actually, the investigation could be a good thing couldn't it? Maybe they are going to pursue MS for abuse or neglect?

Suppose we are gambling (and I do not). We are betting

Lord, if they don't sue him, I think I'll go insane. BUT, THIS TIME, the SCHINDLERS have to get first rate lawyer (no offense to any other prior attorneys)- but its no secret, that Courts are swayed by the reputation of the lawyer standing before the bench.

Yes, but the DCF was going with Jeb to get her when, well, they didn't. But that does make me optimistic that they are investigating a lot of what happened to Terri. I am hoping they are far enough removed from Pinellas County to not be a part of the problem.

IANAL, but I believe that if the investigation takes longer than the Statute of Limitations, he gets a free pass.

Reputation? Sometimes the most important part of "reputation" is your reputation for having given the Judge in question a campaign contribution or having served as a campaign chairman.

Of course, this only applies where judges are elected by the public. In Virginia, where the legislature chooses judges, you can be sure that politics and personal connections have no connection to judges.

An amazing number of freepers told me that it was suspicious that DCF couldn't have control of Terri's records. I asked for proof of that and no one could provide that proof.

Because it was not true.

DCF does have control of Terri's records but the judge ruled the media cannot have her records. Okay. I'll buy that.

Someone will leak. And in the interim, I personally am glad the media isn't finding it easy to get hold of an individual's private medical records.

I am not a lawyer. However, I do watch the news a lot. If you remember the Amy Fischer/Joey Buttafuco I do remember Mary Jo Buttafucco walking around with a bullet in her head and if she was to die as a result of the bullet Amy Fischer would have been brought up on murder charges. The problem here is all the time that has elapsed and the Statute of Limitations. I am sure somebody is looking at this and figuring out ;what ,if anything, to do.

Somehow at this point I doubt Terri would find that a worry.

Regardless, there is no reason for the media to have access to Terri's records.
