I'm not claiming to have more superior knowledge on this matter than anyone else. Unless we are a friend of the family or hospice worker, we all have the same info. I've been "privy" to this topic for months thank you, I only chose to speak my opinion on it for one full day. However, with more replys misquoting my posts from you, you may get the ignorant tag, but only because you've earned it.

Well, de novo was clear enough to be mentioned by the Justice who did not do it. BTW if you do not have personal counsel in court proceedings and a judgement is made concerning you, has due process been achieved?

You are most gracious and honest. Please don't distress yourself any further on this issue; it is obvious from your post that you are not a fan of the evil man who hosts the site. I was concerned that this guy not get a lot of hits and make his website look more, well, popular than it really is. And I didn't want our enemies on the left to link us with that, they do enough damage to our cause. I know Terri's horrific death has stressed many of us to the point of snapping. Let's press on. If that is true, it makes this part of Florida law have no effect.
Florida Statute. 744.3215 Rights of persons determined incapacitated.--
(1) A person who has been determined to be incapacitated retains the right:
...
(l) To counsel.
Because that person must have someone speaking for them in court by circumstance.

And who's going to express to counsel what you wanted when you can't do that, so that aforementioned counsel may effectively represent your interests?
They'll find out if they try pushing it, I suspect, which is why they won't push it. Prediction: there'll be some more shouting for a while, and then the issue will melt away from the front pages without any substantial changes being made to the laws on guardianship.

Yeah. Sure is nice to know that if I ever fall into a vegetative state, or become otherwise incapacitated, Congress will be right there for me, dropping everything in order to insure that my wife's doing a good job of figuring out what I would have wanted. I'm sure she'll also appreciate 535 complete strangers telling her that she might not know me or be doing a good job representing me. Who wouldn't appreciate that kind of state "help" with the most intimate, personal and difficult decisions anyone is ever likely to face?

That is to be determined by the counsel unencumbered by any split loyalty. Here is Florida Law illustrating that concept.
744.331 Procedures to determine incapacity.--
(2) ATTORNEY FOR THE ALLEGED INCAPACITATED PERSON.--
(a) The court shall appoint an attorney for each person alleged to be incapacitated in all cases involving a petition for adjudication of incapacity. The alleged incapacitated person may substitute her or his own attorney for the attorney appointed by the court.
(b) Any attorney representing an alleged incapacitated person may not serve as guardian of the alleged incapacitated person or as counsel for the guardian of the alleged incapacitated person or the petitioner.
How does the attorney represent the wishes of incapacited person in this situation? What is his purpose?
I'll lay you odds, if it were their child, they would be speaking out of the other side of their mouths. It's easier for some to pass judgement on another persons child, disconnected emotions are involved. Always err on the side of life.

Yes, it is. Why are those people even on this board? I really question whether some of them are true conservatives. I seen posts that were trashing Scarborough, Hannity, Rush, even Dr. Dobson, one of the conservative movements most distinguished speakers.
