Really want an answer? Sexual harrassment. Google this phrase by Catherine MacKinnon: "What the decision means is that we made this law up from the beginning, and now we've won." That's exactly what happened. She made it up. And the Supreme Court upheld her. Poof! Instant law, where there had been none before.

I presume you mean that this is yet another example of judicial legislation, not that Roe v Wade and the rest are not judicial legislation...right?
