I don't know how this will be presented as a federal issue, but it seems plausible to use the 14th Amendment, that she has been denied life without due process.

The violation of her due process rights is exactly what judges who actually care about the law and the Constitution should base their reasoning on to overturn the Grim Reaper.

It is an excellent ground under a system of justice, but while we have a system, it apparently is not a system of justice.
