The courts will NOT be the answer to this.

This may put the Supremes in a bit of a bind, though. If they refuse to take this, they're letting stand the 11th's decision that the law is unconstitutional. I wouldn't be surprised to see them stall for time. I agree that it's unlikely there'll be an order issued.

If they decline to hear it then GWB should roll. He can argue, I think properly, that this is a dispute between coequal branches of government. When the USSC declines the case, then they have abdicated their role. Bush needn't answer to a lower court on the balance of powers.
