No, they ordered a de novo review of "any claim of a violation of any right of Theresa Marie Schiavo." The parents filed stating several claims, which were reviewed de novo and dismissed under current law. The court was not ordered to review all evidence from the beginning or start this multi-year process all over again in the federal courts.
Honestly, I don't want to be ruled by either one of them.

I'm not sure--is there are any specific clause/ammendment in the Constitution that would say that Congress can impeach Judges ? I only know that Congress can impeach President.
Read 41. Santorum's just whining for the cameras because the judgement didn't go his way. That's what happens when you leave a judgement up to the same law that has resulted in over a dozen prior judgements in Michael Schiavo's favor.

I don't think they can. All this complaining is just for the cameras and people who don't read decisions. Whittemore in his decision cited Senate transcripts showing without a doubt that the Senate did not intend to influence the judge's decisions in any way, leaving his discretion in issuing an injunction purely up to current law.
There was ample evidence that her rights had been violated. They didn't consider that evidence, all they did was review the state courts findings, and determine that there was nothing to warrant overturning the decisions of the state courts. Much of the problem was the Schindler's incompetent lawyer's fault, but it does not absolve them of duty laid upon the judges by the Congress.
To echo Judge Wilson: I dissent.

Maybe Senate can impeach judges too. Again, I'm not sure and I don't think it's ever happened before.
Clause 6: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.
Clause 7: Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
The Judges should be deprived of food and water also then see how fast Terri would be reconected..May God watch over her.

Yeah, yeah, ...right. And judges now have the power to starve citizens to death for committing no crimes.
From what I read in the decision, Whittemore carefully considered each argument of rights violations and easily shot them down according to law. Maybe the lawyers could have done a better job, but that's not Whittemore's responsibility.
I can relate. Excruciating is close, but then,it's nothing compared to what Terri's state must be.
Twelve judges have been impeached by the House of Representatives. Seven have been removed by the Senate, most recently Judge Nixon in 1989.
Judge Greer has that power, because the Florida Legislature chose to give it to him when it enacted the PVS statute. If you don't like it, blame the Florida Legislature for writing it.
And that's why they find themselves in the position they are now--impotent.
