Federal appeals court grants additional review in Schiavo case

"The 11th U.S. Circuit Court of Appeals in Atlanta agreed to consider a motion by attorneys for Bob and Mary Schindler on the issue that a Tampa federal judge should have considered the entire state court record and not just the procedural history when he ruled against the family.

The attorneys said they were raising the procedural issue now because they have had time to conduct further research on the issues "and have become convinced that the District Court committed plain error when it reviewed only the state court case and outcome history."

The lawyers argued that federal courts should base their ruling on the facts of the case rather than rule on whether a Florida state court was justified in its ruling. There was no time frame for the court to consider the motion."

That's what's worrying. This whole process of considering the motion and issuing a ruling could take some time -- time that Terri doesn't have.
